By accessing and using KeepTrack dental practice management software (“Service”), you agree to be bound by these Terms.

Description of Service

KeepTrack is a cloud-based dental practice management platform used by healthcare professionals to manage patient records, scheduling, billing, analytics, and operational workflows.

HIPAA Compliance

Business Associate Role

KeepTrack acts as a Business Associate under the Health Insurance Portability and Accountability Act (HIPAA).

A Business Associate Agreement (BAA) will be executed with all covered healthcare entities prior to processing Protected Health Information (PHI).

User Accounts

Users must maintain the confidentiality of account credentials and ensure that only authorized staff access the Service.

Acceptable Use

  • Comply with healthcare regulations
  • Avoid unauthorized system access
  • Avoid uploading malicious software
  • Avoid sharing credentials

Termination

Accounts may be terminated for violations of these Terms.

Limitation of Liability

To the maximum extent permitted by law, KeepTrack shall not be liable for indirect or consequential damages.

Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States.

Any legal action shall be brought exclusively in the courts located within the Commonwealth of Massachusetts.

SMS Appointment Reminders

When the SMS reminders feature is enabled, the Service will send text message appointment reminders to patients using a phone number on file with the practice.

  • Message and data rates may apply
  • SMS reminders are informational only and are never used for marketing
  • Patients may opt out by contacting the practice directly
  • By enabling SMS reminders, the practice represents that it has obtained all necessary patient consents required under applicable law, including the Telephone Consumer Protection Act (TCPA). KeepTrack is not liable for regulatory penalties arising from a practice's failure to obtain proper consent.
